Defective or Nonconforming Goods

Non-conforming goods and services are a common problem for both businesses and consumers.

PEMBROKE PINES, FLORIDA, UNITED STATES, September 27, 2018 /EINPresswire.com/ — If an individual or organization find themselves in receipt of non-conforming goods or services, it's time to reach for any contract which may be in place. In some cases, it may be necessary to consult a lawyer, although it's also important to understand the options available from the outset.

"If there's a contract in place, it's best to start there," explains Steven R. Pietro, and established corporate lawyer from Broward County, Florida. Where a written contract doesn't exist, an individual or organization may be covered by an additional set of terms, according to Pietro.

At this stage, he says, whether backed by a lawyer or acting independently, an individual or organization has a number of choices. "They may accept the non-conforming goods," explains Pietro, "although this would be ill-advised. They may also accept the non-conforming goods, but demand a price adjustment."

The corporate lawyer suggests that this is perhaps the most common response, but rarely ideal. Alternatively, a customer or client may reject the non-conforming goods or services entirely, and demand a full refund or a replacement.

"A less common outcome," adds Pietro, "is to accept the non-conforming goods or services with an agreement to have corrected whatever defect or issue exists, with the supplier covering those expenses."

Rarer still, the goods or services may also be rejected and sourced elsewhere, with the original supplier being made to cover any additional costs incurred as a result. "In this instance, it's a good idea to seek legal advice, especially where there's a significant value attached to the non-conforming goods or services in question and their replacement," Pietro adds.

In terms of business-to-business sales, from a legal standpoint, it's advisable to refer to the Uniform Commercial Code. First published in 1952, the Uniform Commercial Code is one of several uniform acts put into legislation with the goal of harmonizing the law of commercial transactions across the U.S.

"The Uniform Commercial Code is the body of laws governing commercial transactions in the U.S.," says Pietro, "and is something which an experienced lawyer will be able to advise on in detail."

A lawyer will also be able to advise on steps which can be taken to prevent similar future problems, such as by implementing a right to inspect clause into new contracts.

"If there's any doubt," Pietro adds, wrapping up, "consult with a lawyer before agreeing to any solution which may prove to be anything less than entirely favorable in its outcome."

The Transnational Government of Tamil Eelam (TGTE) released today its response (Link below) to Sri Lankan President Maithripala Sirisena’s September 25th speech before the 73rd Session of the UN General Assembly, during which the President backtracked on Sri Lanka’s commitment to secure justice for the victims of international crimes that occurred at the hands of the Sri Lankan state during the county’s criminal conflict, which ended in 2009.

TGTE’s written response to the President’s speech includes a “Report Card for the Sri Lankan Government,” detailing the island nation’s many failures to date to uphold its promises to deliver justice, as stipulated by UN Resolution 30/1. TGTE also calls for the creation of an International, Impartial and Independent Mechanism to investigate, document and prosecute humanitarian law breeches and crimes against humanity committed by the Sri Lankan state, as documented by at least three UN investigative reports.

“Since Sri Lanka is an ethnocratic state, justice cannot be meted out to Tamils within Sri Lanka. It can be done only in the International Criminal Court. Nearly 2 million people have subscribed to this view by participating in the TGTE’s ‘Refer Sri Lanka to the ICC’ campaign,” TGTE Prime Minister Visuvanathan Rudrakumaran said. “I also have to point out that this month, the Northern Provincial Council passed a unanimous resolution calling for referral of Sri Lanka to the ICC. The proposed independent mechanism is in the meantime to collect and preserve the evidence since evidence are being destroyed and witnesses are under threat inside the island of Sri Lanka,” added Prime Minister Rudrakumaran.

TGTE’s written response to President Sirisena’s Sept. 25th speech also makes clear that the Sri Lankan state continues to violate Tamils’ human rights with its use of torture and failure to resettle internally displaced Tamils, among several other failures of grave concern, having never been held to account. TGTE’s written response to the President also highlights steps that the international community can and should take to bring Tamil victims closer to justice and to protect the authority, credibility and values of the UN.

“If the General Assembly acquiesces to Sirisena’s request [to abandon international accountability], it will have helped him write the last chapter in Sri Lanka’s ‘Playbook for Impunity’,” Prime Minister Rudrakumaran says in TGTE’s written response. “A playbook that challenges the very relevance and effectiveness of the entire human rights system.”

Generally, a tax is imposed a mark-to-market regime on wealthy expatriates by providing that all property owned by a covered expatriate is treated as sold on the day before the expatriation date for its fair market value. Any gain arising from the deemed sale is taken into account for the taxable year of the deemed sale notwithstanding any other provisions of the Code. Generally, any loss from the deemed sale is taken into account for the taxable year of the deemed sale to the extent otherwise provided in the Code. There is a minimum amount of gain that can be earned of $600,000, which amount is to be adjusted for inflation for calendar years after 2008 (the “exclusion amount”). A taxpayer may elect to defer payment of tax attributable to property deemed sold.”

The cover-ups are happening all of the time because Governor Cuomo has directed the internal reporting of sexual assaults and the bypassing of 911 call systems and local police. The State’s MO, if it isn’t documented, it didn’t happen. The cover-ups of sexual assaults and rapes are massive in scope.

On top of almost all sexual assaults and rapes of our most vulnerable being covered-up, Governor Cuomo and his agencies are unconscionably placing convicted sex offenders in these State and private facilities and group homes. The Commissioners of the Department of Corrections and the Office of People with Developmental Disabilities and anyone else involved are directly endangering the safety and welfare of incompetent individuals.

Governor Andrew Cuomo is ultimately in charge, these are his mental health agencies that are rampant with sexual assaults and rape. These agencies operate almost identically to the Catholic Church. These illegal practices must be immediately stopped.

New York State penal law 260.25 says it is a felony criminal offense to Endanger the Welfare of an Incompetent or Physically Disabled Person.

“A person is guilty of endangering the welfare of an incompetent or physically disabled person in the first degree when he knowingly acts in a manner likely to be injurious to the physical, mental or moral welfare of a person who is unable to care for himself or herself because of physical disability, mental disease or defect.

Endangering the welfare of an incompetent or physically disabled person in the first degree is a class E felony.”

Other state and federal laws require safe living environments for all individuals with disabilities that are free from abuse and neglect.

These statements were just released by New York State Senator Rob Ortt who is also the Mental Health Committee Chairman;

“According to the report, these sex offenders are being placed in homes without notice, raising concerns about how widespread this occurrence may be.”

“This practice must stop immediately,” said Ortt. “In no circumstance should the most vulnerable members of our society be placed in the same home as individuals convicted of preying on the vulnerable. The Level of government incompetence displayed here is astonishing.”

Governor Cuomo and agency heads involved remain silent, they appear to be out of control and have no regard for the safety or equal rights of 1,000,000 New Yorkers with disabilities. It is time for the top officials involved in these criminal cover-ups of rapes and deaths and the placement of sex offenders with the disabled which are civil rights atrocities to be investigated by federal authorities, indicted and held fully accountable for their crimes.
